I. OPENING STATEMENTS
The Health Agent informed the Board that a second racoon was found to have rabies. Goody Hallett Road is the area both animals were found.
Jane Crowley also reported that 3 beaches had been closed Cooks Brook, South Sunken Meadow, and Long Pond due to the high levels of bacteria that were detected when tested.
VARIANCES
1. Katsiadicas 40 Huckleberry Lane Map-7 Parcel-338 7339
Gorge Reilly (Land Design Associates) presented the plan to upgrade the septic system. The Board recommended secondary treatment be added to the plan. Paul Lothrop made the motion to continue this hearing until new plans with secondary treatment is presented. Pat Lariviere seconded the motion .
VOTE WAS 5-0 FOR CONTINUATION.
2. Cafro 13 Nycoma Way Map-10 Parcel-327
Thomas Joy (Coastal Engineering) presented the plan to upgrade the septic system. The variances requested are as follows:

15.211 Minimum Setback Distances
Leaching chamber less than 100' from existing private water supply
24' variance requested from Cafro
12' variance requested from Kingsbury
24' variance requested from Prifty
19' variance requested from Potter

No reserve area provided - remove and replace if necessary

Upgrade of failed system in sensitivity area (within 100 feet of dune - F. 1a)
Finding that the plan achieves maximum feasible compliance, the aforementioned variances were approved with the following conditions:
1 Voc and routine water quality test results be provided of existing well location to assure potability prior to approval
No increase in design flow be allowed
Secondary treatment and monitoring under remedial use approval conditions per DEP regulations including testing quarterly for total nitrogen (or 2 times per year for seasonal use) to meet minimum standard of 19 mg nitrate nitrogen/l. After this time reduction of testing could be requested to BOH by owner.
Operation and maintenance agreement to be submitted to EBOH. Operation and maintenance agreement to be required for life of the system. Operator to report results using Carmody Data Base if available or submit written reports directly to the Eastham Board of Health.
Deed restriction for 3 bedroom use and alternative technology requirement to be recorded.
Designer to verify proper operation of the system prior to issuance of Certificate of Compliance.
Well disclaimer to be signed by owner.
Add uv treatment and test for fecal coliform - test parcel 326, 319. 328 for routine parameters.
Stan Holt made the motion to approve the plan with the 8 conditions.
Dr. Taylor seconded the motion.

Lynch 13 &15 Bayberry Lane Parcel-149 & 150
Jason Ellis (J.C. Ellis Design) presented the plan to upgrade the septic system. The variances requested are as follows:

1. 26' from proposed s.a.s. to well (pcl. 170)
2. 9' from proposed s.a.s. to well (pcl. 171)

Finding that the plan achieves maximum feasible compliance, the aforementioned variances were approved with the following conditions:
1. Routine and VOC water quality test results be provided of proposed well location to assure potability
2. No increase in design flow be allowed
3. Secondary treatment and monitoring under general use approval conditions per DEP regulations including testing quarterly for total nitrogen, BOD, TSS, Nitrate (or 2 times per year for seasonal use) with effluent limit not to exceed 19 mg/l nitrate- nitrogen per Eastham Board of Health requirement, after this time reduction of testing could be requested to BOH by owner.
4. Operation and maintenance agreement to be submitted to EBOH. Operation and maintenance agreement to be required for life of the system.
5. Deed restriction for 3 bedroom use and use alternative technology requirement to be recorded on deed.
6. Designer to verify proper operation of the system prior to issuance of Certificate of Compliance
7. Subject to Conservation Commission approval.
8. Any increase in habitable square footage would require Board of Health review
9. Livable space not to exceed 2,491 sq. ft.
10. Partial 170 &171 to be tested for routine parameters.

REVIEW:
Coastal Land Design 35 West Road Map-4 Parcel 533
At their meeting on Thursday July 28, 2005 the Eastham Board of Health approved the Title 5 variances as listed per plan Bennett & O’Reilly dated 8/11/2004 and revised 5/11/2005 to add secondary treatment with an Orenco Advantex AX 20 system ( Model 3a) .
Finding that the plan achieves maximum feasible compliance, the aforementioned variances were approved with the following conditions:
Voc and routine water quality test results be provided of existing well location to assure potability prior to approval.
2. No increase in design flow be allowed.
3 Secondary treatment and monitoring under general use approval conditions per DEPRegulations including testing quarterly for total nitrogen fecal coliform (or 2 times per year for seasonal use) to meet minimum standard of 19 mg nitrate nitrogen/l. After this time reduction of testing could be requested to BOH by owner.
Operation and maintenance agreement to be submitted to Eastham Board of Health. Operation and maintenance agreement to be required for life of the system.
5. Deed restriction for 3 bedroom use and alternative technology requirement to be recorded.

Evaluate existing pit prior to installation of secondary treatment.
Add UV treatment .
